(“LYM”) when accessing and using the Websites, through which the User may access content made available by the brands Observatório Sustentável, Direitos dos Pets, and L.Marques Consultoria Ambiental, such as articles, news, images, videos, research, courses, and workshops related to environmental law, climate law, animal rights, the environment, and sustainability, among other initiatives and actions.

 

This Privacy Policy has been implemented in accordance with the obligations set forth in Law No. 12,965, of April 23, 2014 (“MCI”), and Law No. 13,709, dated August 14, 2019 (“LGPD”), as well as other laws and regulations applicable to the processing of Users’ Personal Data (“Applicable Data Protection Legislation”).

  • For the purposes of this Privacy Policy, capitalized terms, unless otherwise defined in this Privacy Policy or in the Applicable Data Protection Laws, shall have the meanings set forth below:

 

1.1.1. IP Address: Internet Protocol address, the code assigned to a network terminal to enable its identification, defined according to international standards.

 

1.1.2. Internet: the system consisting of a set of logical protocols, structured on a global scale for public and unrestricted use, with the purpose of enabling data communication between devices through different networks.

 

1.1.3. Password: a set of characters that may consist of letters and/or numbers, used to verify the User’s identity for access to the restricted area of the Websites.

 

1.1.4. Websites: the websites available at the addresses www.lmarques.com.br; www.observatoriosustentavel.com.br, and www.direitosdospets.com.br, which are brands associated with LYM and through which the User accesses the Content.

 

1.1.5. Users (or “User,” when considered individually): all individuals who access and use the Websites, , it being understood that the Websites are intended solely for individuals who are at least 18 (eighteen) years of age or emancipated and fully capable of performing civil acts, or those who are absolutely or relatively incapable, provided that, in the latter case, they are duly represented or assisted.

2.1. LYM values the security and confidentiality of the information provided by Users. For this reason, we have adopted the necessary measures to protect Users’ rights, which can be found in this Privacy Policy, an integral part of the Terms of Use (“Terms of Use”), available on the Websites.

This Privacy Policy details how Personal Data and other information are processed, and explains how your Personal Data is collected, accessed, stored, used, processed, transferred, and disclosed, as well as how we allow Users to access, correct, delete, or restrict the processing of their Personal Data.

The User is aware and agrees that the existence of these links does not constitute an endorsement or sponsorship of third-party websites by LYM and acknowledges that they are subject to the terms of use and privacy policies of the respective website(s).

 

3.4.1. The Sites were created using Hostgator’s website builder. Hostgator does not list cookies related to LYM, but it is possible that uses cookies to ensure the proper functioning and efficiency of the Sites. Hostgator’s Privacy Policy is available here for review.

6.1. LYM takes all technical and organizational measures to protect the Personal Data of Website Users against loss, unauthorized use, or other abuses, ensuring a level of security consistent with the activities carried out by the Sustainable Observatory.

 

6.2. Personal Data will be stored in a secure operating environment that is not accessible to the public. We strive to protect the Personal Data we store through measures such as (i) adopting a governance and privacy program; (ii) establishing a team responsible for Personal Data Protection and appointing a Data Protection Officer; (iii) incorporating the principles of “Privacy by Design” and “Privacy by Default” during the performance of activities; (iv) establishing confidentiality policies with employees; (v) restricting access to Personal Data based on the “need-to-know” and “least privilege” principles, among others. Despite this, unfortunately, we cannot guarantee complete security. Unauthorized use of accounts, hardware or software failures, and other factors may compromise the security of your Personal Data at any time; therefore, we need Users’ help to maintain a secure environment for everyone .

7.1. LYM does not transfer Personal Data collected in Brazil to other countries. LYM is headquartered in Brazil, and the Personal Data it collects is stored on servers located within Brazil.

8.1. When you use the Websites and provide your Personal Data to LYM, LYM will ensure the rights set forth in the Applicable Data Protection Laws, namely:
